1) Acceptance of terms

By accessing or using Toecial, you agree to these Terms & Conditions, our Privacy Policy, and all applicable laws.

2) Eligibility and accounts

• You must be 18 years of age or older to use this platform.
• You must provide accurate account information and keep your credentials secure.
• You are responsible for all activity under your account.
• We may suspend or terminate accounts that violate these terms or applicable law.

3) Community safety and prohibited behavior

• No harmful, abusive, threatening, hateful, exploitative, or unlawful content.
• No harassment, bullying, stalking, intimidation, or doxxing.
• No fraud, impersonation, deceptive activity, malware, or attempts to bypass platform security.
• No spam or unsolicited promotional abuse across comments, DMs, or other channels.
• No content depicting minors in a sexual manner, under any circumstances.

3a) Prohibited content categories

The following categories of content are strictly prohibited and will result in immediate removal, account termination, and may be reported to law enforcement:

• Any sexual content depicting or involving minors (CSAM), including simulated or illustrated depictions.
• Any content depicting or promoting rape, sexual assault, or non-consensual sexual activity, including content framed as fantasy or roleplay.
• Bestiality or sexual content involving animals.
• Content depicting incest, whether real or simulated.
• Snuff, gore, extreme violence, or self-mutilation in a sexual context.
• Content depicting necrophilia or autopsy imagery in a sexual context.
• Sexual content involving the use of chloroform, hypnosis, or drugging to depict or simulate incapacitation.
• Voyeuristic content filmed or obtained without the consent of the depicted person(s).
• Content depicting kidnapping, abduction, or unlawful confinement in a sexual context.
• Sexual content involving suffocation or non-consensual breath play depicted as real.
• Urination, defecation, vomiting, or other bodily excretions directed at another person in a sexual context.
• Content promoting, advertising, or facilitating prostitution or sex trafficking.
• Racist, hate-based, or sacrilegious content.
• Content depicting the crushing of animals.
• Any content that sexualizes sleeping persons without verified consent.
• Content that explicitly uses language such as "forced," "rape," or similar terms in titles, descriptions, or tags regardless of whether the content itself is consensual.

4) Anti-harassment rule across all communication channels

Subbers and Artists (and all users) must not harass any person by any means, including but not limited to comments, DM/chat, email, text message, or any direct communication connected to platform activity.

5) Artist status and independence

Artists are independent contractors and are not employees, agents, or representatives of Toecial. Artists are solely responsible for their content, taxes, legal obligations, and business decisions. Artists must also accept and comply with the separate Content Provider Agreement before publishing creator content.

6) Content ownership, rights, and moderation

• Users retain ownership of content they lawfully upload.
• You grant the platform a limited license to host, display, process, and distribute your content to operate the service.
• We may remove, restrict, or disable content or accounts that violate these terms, laws, or safety policies.

7) Payments, purchases, and access

• Paid content, subscriptions, and unlocks are governed by displayed pricing at time of transaction.
• Chargebacks, payment abuse, or fraudulent purchases may result in suspension or termination.
• Taxes, processor fees, and payout timelines may apply based on account type and region.
• All billing is processed by CCBill, LLC. We do not collect or store payment card information on our servers.

7a) Cancellation policy

If you have an active recurring subscription, you may cancel at any time by contacting CCBill Consumer Support directly:

Cancellation stops future recurring charges. Access to paid content may continue until the end of the current billing period. Refund requests for subscription charges are handled on a case-by-case basis by CCBill Consumer Support.

8) Intellectual property and takedowns

You may not upload or distribute content you do not have rights to use. We respond to valid infringement reports and may remove content pending investigation. See our DMCA Policy for details.

9) Disclaimers and limitation of liability

The service is provided on an "as is" and "as available" basis. To the fullest extent allowed by law, the platform disclaims implied warranties and limits liability for indirect, incidental, or consequential damages.

10) Enforcement and termination

We may investigate suspected violations and take enforcement action, including warnings, content removal, feature restrictions, account suspension, or permanent termination.

11) Changes to terms

We may update these terms as the business evolves. Continued use after changes constitutes acceptance of updated terms.
