Content Provider Agreement

This Content Provider Agreement applies to every artist, creator, model, performer, producer, uploader, or other person who submits content to Toecial. It is separate from the Terms & Conditions and must be accepted before creator publishing access is granted.

1) Adult age and identity verification

• You certify that you are at least 18 years old.
• You agree to complete government-document-based identity and age verification when requested.
• You agree not to submit content until all required verification and compliance checks are complete.

2) People depicted in content

For every person depicted in any photo, video, audio/video recording, or other uploaded media, you certify and agree that:

• The person was at least 18 years old at the time the content was created.
• The person's identity and age were verified using valid government-issued identification.
• The person knowingly and voluntarily consented to being depicted in the content.
• The person consented to publication, distribution, sale, licensing, and platform display of the content.
• The person consented to download of the content where download access is enabled by the platform or purchase terms.

3) Required records

You must maintain accurate records sufficient to prove identity, age, ownership, and written consent for every person depicted in your content, including any required 18 U.S.C. Section 2257 records and model releases. You agree to provide those records promptly if requested for legal, compliance, payment processor, card-network, or complaint-review purposes.

4) Prohibited content and conduct

You must not upload, sell, promote, request, or facilitate content or activity involving:

• Minors or any child sexual abuse material, including simulated or implied minor exploitation.
• Non-consensual content, coercion, force, fraud, trafficking, blackmail, or exploitation.
• Content created while a depicted person was unconscious, incapacitated, drugged, or unable to consent.
• Violence, threats, hate, bestiality, incest, illegal services, prostitution, or any other unlawful content.
• Content for which you do not own or control the necessary rights, releases, licenses, and permissions.

5) Rights granted to the platform

You retain ownership of content you lawfully create and upload. You grant Toecial a license to host, store, process, display, transmit, promote, sell, license, and otherwise use the content as needed to operate the service, provide purchases or subscriptions, enforce policies, comply with law, and process refunds, disputes, chargebacks, or takedown requests.

6) Complaints, removals, and cooperation

You agree to cooperate with any complaint, content removal request, consent dispute, age-verification inquiry, 2257 inquiry, processor review, or law-enforcement request. If we determine that content was uploaded without required consent, documentation, rights, or legal compliance, we may remove or restrict the content and suspend or terminate the account.

7) Payment processor and card-network compliance

You agree to comply with applicable CCBill, payment processor, payment card association, legal, tax, and platform rules. Content may be rejected, removed, or restricted if required by processor, bank, card-network, or legal compliance standards.
